Case Dismissed After Inmate Sued Our Client for Medical Malpractice and Negligence for Alleged Delay in Treatment

Area of Law:
Medical Malpractice Defense

Venue:
Michigan Circuit Court (2015)

Verdict:

Dismissed – Summary Disposition; No appeal

Details:
The inmate plaintiff was incarcerated in a county jail and complained of a skin infection from a spider bite. Medical personnel at the inmate’s facility properly assessed the patient and provided appropriate treatment. The inmate sued Defendant Medical Providers, alleging that treatment for his skin infection was improperly delayed. The Court granted our motion for summary disposition and dismissed the complaint because the inmate failed to file an affidavit of merit with his complaint and did not serve a notice of intent prior to bringing his lawsuit as required by Michigan law.
