A Michigan dental hygienist’s license was suspended for failure to enter into a contract with the Health Professional’s Recovery Program (HPRP) following a DUI. We petitioned for dissolution of the summary suspension and were granted a hearing before an administrative law judge.
After successful cross examination of the State’s witnesses at the hearing, the judge gave a directed verdict in our favor after our showing that the state failed to prove their case. The judge dissolved the suspension and the hygienist returned to practice that day. Our attorneys have achieved directed verdicts in a large number of summary suspension cases as a result of cross examination of the state’s witnesses. Our extensive knowledge on the applicable law, medicine, and policies and procedures of the HPRP give us an advantage in the courtroom for health professionals facing administrative issues arising out of HPRP related summary suspensions.
