Nurse Accused of Stealing Narcotics Returns to Practice

Primary Issue:
Nurse was accused of stealing narcotics after an anonymous complaint was made to the Board of Nursing that the nurse was removing a large volume of narcotics from the facility she worked. After receiving the complaint, the Board of Nursing issued an Order of Summary Suspension pursuant to MCL 333.16231 for drug diversion. We immediately petitioned for dissolution of the summary suspension after preforming an investigation and were successful in obtaining an order from the judge dissolving the summary suspension and allowing the nurse to return to work. Ultimately, through presentation of evidence and cross-examination of witnesses, we were able to convince the judge that the complaint against the nurse for stealing narcotics was not credible and our client was not responsible for the removal of the narcotics.

Result:
The Administrative Law Judge dissolved the summary suspension and allowed the nurse to return to practice.
