The physician received her fourth driving under the influence (DUI) conviction, a felony in the State of Michigan. The physician’s medical license was summarily suspended after reporting the DUI conviction to the medical board.

The evaluator was able to provide a favorable recommendation before the administrative law judge and we were able to successfully cross-examine the arresting officer to provide mitigating/extenuating evidence. Ultimately, the administrative law judge quickly dissolved the summary suspension and the client was able to return to work pending resolution of her medical licensing issues.
The dissolution of the summary suspension allowed us to have a greater bargaining position with the Board of Medicine and we were able to negotiate a consent agreement which would allow the physician to continue practicing under the supervision of a two (2) year monitoring agreement. The physician was later admitted into Health Professionals Recovery Program (HPRP) and is currently practicing with a two (2) year monitoring agreement.
