RN With Positive Pre-employment Drug Test for THC Reported to Board of Nursing

Primary Issue:
RN tested positive for THC in a pre-employment drug screen and was reported to the Board of Nursing, who then started an investigation.

The nurse retained our attorneys immediately after learning of the positive drug screen to help protect their nursing license and clearing his name before a formal complaint was filed. The RN wanted to prevent a formal complaint from being filed so that the nurse could continue to practice as a travel nurse and avoid an IPN referral. We obtained several character references, multiple prior drug screens (all negative) and we had him evaluator by a board certified addiction specialist. We submitted a great addiction evaluation, four character references, evidence of completion of 12 CME credits, and a letter of explanation and apology to the Probable Cause Panel.

Result:
The Board of Nursing Probable Cause Panel issued a non-disciplinary Letter of Guidance. The RN avoided a formal complaint and avoided a referral to IPN.
